SpinPod 360 Hire Terms and Conditions

SpinPod 360 provides an advanced and fun 360° photo booth experience. We have moved on from the boring 4 image photo booth option and provide 360° videos to capture the memories and beauty of every event. Our new high-tech product produces videos for people to share their special memories or promote their product.

Hiring, Delivery and Service

A SpinPod 360 attendant will remain with the SpinPod ‘360 Video Booth’ for the duration of the booking time. The complete details and inclusions of your package will be disclosed to you by SpinPod 360 at the time of your booking.

Our Requirements / Workplace Health & Safety requirements

We require one chair and a clean, flat, dry area of approximately 3.5m x 3.5m x 3.2m (which includes space for our attendant tables) and one normal power outlet within 10 metres.

If the SpinPod ‘360 Video Booth’ is to be set up outdoors, the booth and attendant will require sufficient protection from the elements, in the form of sufficient opaque overhead and side cover on at least two sides, to afford protection from rain, humidity, wind and/or sunlight. It will be the hirer’s responsibility to ensure their venue function coordinator or private function coordinator is made aware of these requirements and can accommodate them. Any uncovered outdoor setup will need to be discussed with SpinPod 360 prior to booking.

For safety reasons and to protect the 360 SpinPod ‘360 Video Booth’, drinks, glasses or bottles, food or cigarettes are not allowed on the SpinPod ‘360 Video Booth’. For safety reasons and to avoid damage to the booth, chairs are not permitted on the SpinPod ‘360 Video Booth’ at any time. For safety reasons and to protect the SpinPod ‘360 Video Booth’, clients and guests are not permitted to pick up other guests, when on the SpinPod ‘360 Video Booth’.

Safety precautions/booth rules:
* No food, drinks, cigarettes on the booth or in the 360 Video Booth area.
* No chairs or other objects to stand on to be taken onto the SpinPod ‘360 Video Booth’.
* No lifting up guests, piggy backing or hand stands, or any kind of gymnastics on the SpinPod ‘360 Video Booth’.

Use of Images/Privacy

When hiring from SpinPod ‘360 Video Booth’s, the hirer gives permission for Videos captured at the event to be used on the SpinPod 360 website and for advertising purposes including the posting on Social Media Platforms and for use of Social Media Marketing, unless the client requests otherwise.

SpinPod 360 will not use videos which are deemed unsuitable or inappropriate on our website or on Social Media or for advertising and will not use any content that we consider may be personally damaging to any person(s).

SpinPod 360 will not sell your personal details to any third party and will take all reasonable measures to ensure that your personal details remain confidential.

Failure to Complete

At all times care will be taken by SpinPod 360 to ensure delivery, however, should unforeseen equipment failure prevent this, during the normal course of events, liability will be limited to a total or partial refund of monies paid, dependant on our deliberation of the unique circumstances and/or the amount of the booking that was fulfilled successfully.

SpinPod 360 cannot be held in any way liable if equipment or accessories failure or damage (including electrical, water or other liquid damage) is due to any negligence, an act or fault on the part of any venue
or venue staff or is due to any negligence, act or fault on the part of any client or client guest or other person using a SpinPod ‘360 Video Booth’ at your event/function, which negligence, act or fault, wilful or accidental in turn prevented the successful completion of the agreed to SpinPod 360 service(s).

Short Bookings

Should the client, or their representative decide to extend the booked time during the course of the event, the extended rates will be $100 per half hour (incl GST), payable at the beginning of the extended time, as a cash payment or otherwise agreed by SpinPod 360.

Delays

SpinPod 360 cannot be held responsible for unforeseen delays at the venue, which are out of our control.

Force Majeure

SpinPod 360 will not be liable for failing to perform under the agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, fire, threatened or actual act of terrorism, natural disaster, extreme weather events (including but not limited to flooding, cyclones, earthquakes, which events might prevent the SpinPod 360 attendant from attending the venue or to perform his/her duties whilst at the venue), or war. SpinPod 360 will not be held liable for failure to attend a booked event or complete a booked event in the event of closure of the venue prior to or during a booked event or cancellation of a booked event by the venue or by cancellation of a booked event or closure of the venue by other parties or Government authorities, representatives or bodies.

Payments

A 30% deposit payment of the total hire fee is required from the hirer or their agent, within prior to confirmation of booking. The remaining balance will be payable by the hirer or their agent at least 14 days before the booked date, unless otherwise agreed to in writing by both parties.

Security Statement

Our banking details for direct deposit will be noted on your invoice and should not change at any time. If you receive any emails purporting to represent SpinPod 360, listing changes to our banking details, please contact SpinPod 360 by phone before making any payments. We will not be held liable for payments made to the wrong location.

Cancellation

If a booking is cancelled by the hirer or their agent or SpinPod 360 is unable to attend the booked event due to cancellation by the hirer or their agent for any reasons more than 30 days prior to the booked date, the deposit will be refunded, less a $100 administration fee. If a cancellation is made by the hirer or their agent or SpinPod 360 is unable to attend the booked event due to cancellation by the hirer or their agent for any reason within 30 days of the booked date, the deposit will be forfeited and all monies paid above the deposit will be refunded, less a $100 administration fee. If SpinPod 360 has not received final payment for a booking at least 24 hours before the booked date, SpinPod 360 will deem that a cancellation on behalf of the hirer and all monies paid to date will be forfeited, unless both parties have made prior mutually agreed to arrangements in writing for a late payment.

Postponement

If a client wishes to move a booking to another date it will be at the discretion of the SpinPod 360 management staff as to whether this is a viable option. In most cases a postponement can be arranged, however if the management deems the postponement unviable, the booking will be deemed a cancellation and the above cancellation terms will apply.

Miscellaneous

The SpinPod ‘360 Video Booth’ operator may pause or terminate the use of the SpinPod ‘360 Video Booth’ at any time during the event if they consider that the guests are behaving in a way that the operator(s) believes to be dangerous to themselves or any persons, or potentially damaging to the product.

The SpinPod ‘360 Video Booth’ attendant reserves the right to exclude a person or persons from the SpinPod ‘360 Video Booth’ if the attendant considers that person to be grossly intoxicated or behaving in an aggressive or abusive manner towards the SpinPod ‘360 Video Booth’ attendant or behaving in a manner that the SpinPod ‘360 Video Booth’ attendant considers may damage SpinPod 360’s property.

The SpinPod ‘360 Video Booth’ operator may pause the use of SpinPod ‘360 Video Booth’ to troubleshoot any technical function or repair. Any time lost that is greater than 20 minutes in duration will result in hire time extended without additional overtime fee, for a period of half the lost time. For times less than 20 minutes, any extension of time will be up to the discretion of the SpinPod ‘360 Video Booth’ operator.
